1. Scope of Application
These General Terms and Conditions (GTC) govern the use of the platform carvalando.ch (hereinafter referred to as "Platform"). By accessing or using the Platform, you agree to these GTC. Carvalando.ch is an independent comparison and brokerage platform for car leasing and car subscriptions in Switzerland.
2. Terms of Use
2.1 The use of the Platform is exclusively permitted for natural persons aged 18 and over as well as legal entities based in Switzerland. The use of the Platform is free of charge for users.
2.2 Any abusive use is prohibited. This includes in particular:
- Circumventing security and access restrictions,
- Disseminating false, misleading, or unlawful information,
- Commercial reuse of content without consent.
2.3 Carvalando reserves the right to temporarily or permanently block users in case of abuse and to initiate civil and criminal proceedings.
3. Brokerage Nature of the Platform
3.1 Carvalando acts solely as a comparison and brokerage platform. Carvalando does not itself enter into leasing or car subscription contracts.
3.2 The contractual partner upon conclusion of a leasing or car subscription contract is exclusively the respective provider. Carvalando assumes no responsibility for:
- the conclusion of a contract,
- the content design,
- the execution, fulfillment, or termination of the contractual relationship between the user and the provider.
3.3 Any claims arising from breaches of contract must be asserted directly against the respective provider.
3.4 Any remuneration provided by providers (e.g., commissions or advertising fees) has no influence on the order, weighting, or presentation of search results.
3.5 Carvalando does not act on behalf of or at the request of a provider and does not enter into contracts itself.
4. Remuneration / Commission Notice
4.1 Carvalando may receive remuneration (e.g., commission, lead fee, or advertising flat rate) from providers when a user submits an inquiry or concludes a contract via the Platform.
4.2 This remuneration has no influence on:
- the fundamental inclusion of offers,
- the comparison function, and
- the transparency of the presented conditions.
4.3 If individual offers are particularly marked or advertised, this is clearly indicated as advertising or "advertisement".
5. Price Declaration
5.1 Displayed prices and conditions are non-binding market indications. Deviations between advertised and actually offered contractual conditions may occur; legally binding are exclusively the details of the respective provider.
5.2 Actual monthly rates may vary depending on the vehicle, duration, mileage, provider conditions, and the time of the user's offer request.
5.3 Carvalando assumes no liability for deviations.
6. Offer Information and Binding Nature
6.1 The offers, prices, images, and conditions displayed on carvalando.ch are provided and are the responsibility of the respective providers.
6.2 Carvalando does not guarantee:
- accuracy,
- completeness,
- timeliness, or availability of the displayed offers.
6.3 Only the details and contractual documents of the respective provider at the time of contract conclusion are authoritative and legally binding. Users are obliged to carefully review all contractual conditions of the provider before signing.
7. Disclaimer of Liability
7.1 Carvalando is liable only for intentional breaches of duty and mandatory statutory liability (in particular personal injury).
7.2 Carvalando is liable – to the extent permitted by law – only for intentional and slight negligent breaches of duty. Liability for gross negligence remains reserved according to Art. 100 OR.
7.3 Mandatory statutory liability provisions remain unaffected.
8. User Account and Registration
8.1 If users create a customer account, they are obliged to:
- keep the information provided during registration truthful, complete, and up to date,
- treat access data confidentially and not disclose it to third parties.
8.2 Carvalando is entitled to temporarily block or permanently delete user accounts if there is a suspicion of abuse, false information, or violation of these GTC.
9. Copyright
All content published on carvalando.ch – in particular texts, logos, graphics, images, layouts, and software – are protected by copyright and are owned by Carvalando or the respective rightful third parties. Any reproduction, editing, distribution, or public presentation outside of the legally permitted private use requires the prior written consent of Carvalando.
10. External Links
The Platform may contain links to websites of providers or other third parties. Carvalando has no influence on their content and assumes no responsibility for it. The respective operator is solely responsible for the content, accuracy, legality, and functionality of linked pages.
11. Data Protection
11.1 The processing of personal data is carried out in accordance with the Swiss Data Protection Act (DSG) and the current Privacy Policy of Carvalando (https://carvalando.ch/datenschutz)
11.2 When submitting an inquiry, Carvalando collects only the personal data necessary for this purpose (e.g., name, contact information, desired vehicle) and forwards this to the chosen provider for the creation of the offer. The processing is carried out in accordance with the provisions of the Swiss Data Protection Act.
12. Changes to the GTC
12.1 Carvalando reserves the right to change these GTC at any time. The current version will be published on the Platform and will apply from the time of publication.
12.2 Continued use of the Platform after the publication of amended GTC is deemed to be acceptance of these changes. Users will be informed of significant changes via email or through their user account.
13. Applicable Law and Jurisdiction
13.1 These GTC and the use of the Platform carvalando.ch are exclusively subject to Swiss law, excluding conflict of law provisions (in particular the IPRG).
13.2 The exclusive place of jurisdiction for all disputes arising from or in connection with the use of the Platform and these GTC is Zug, Switzerland.
13.3 For users who qualify as consumers within the meaning of Art. 32 para. 1 ZPO, the legally provided place of jurisdiction at the consumer's residence also applies.
